This book is a tribute to honour Chief Justice Dipak Misra for his constitutional wisdom. I admired his recognition in Johar that the human desire for joy is a legitimate and universal feature of humanity. It is one that he has introduced into the explanation of the constitutional morality of India. In this respect, he follows the precedent given by omas Je erson who wrote in the United States Declaration of Independence that the purpose of government is the protection of “life, liberty and the pursuit of happiness.” Je erson and Dipak Misra thus go down in history together as defenders of “happiness” and “joy.” -JUSTICE MICHAEL KIRBY Misra CJ (in the companionship of other Justices) has done great service to the nation and the traditions of constitutional justicing by articulating the concept of constitutional morality scattered all across prior decisions. He has also brought a new alignment by relating it to other key concepts like “constitutional renaissance,” “constitutional objectivity,” constitutionally just “good governance” and “constitutional culture.” He has placed these allied concepts in the service of constitutional construction in aid of preserving, promoting and protecting core human rights.
